1. Acceptance of Terms

Welcome to GitAlert, an automated deployment service provided by Yevhen Salitrynskyi ("we", "us", "our"). By using the GitAlert website at gitalert.com ("Site") and our services ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, please do not use our Service.

2. Description of Service

GitAlert is a service currently in beta that facilitates the deployment of projects from git repositories to servers using SSH/FTP/SFTP protocols.

3. Use of Service

By using GitAlert, you commit to using the Service in a manner consistent with all applicable local, state, national, and international laws and regulations. The Service is not to be used for any illegal or unauthorized purpose. Any unauthorized use or violation of these Terms may result in termination of your account.

4. Account Security and User Credentials

You are responsible for maintaining the security of your account and password. GitAlert cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

5. Beta Service Disclaimer

GitAlert is provided on an "as is" and "as available" basis, and you use it at your own risk. We expressly disclaim all warranties, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee continuous, uninterrupted, or secure access to our Service, and operation of our Site may be interfered with by numerous factors outside of our control.

6. Changes to Service and Terms

We reserve the right to modify, suspend, or discontinue the Service or any part of it without notice at any time. We may also revise these Terms at any time, and the most current version will always be posted on our website. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

7. Payment and Subscription Terms

GitAlert offers subscription plans, billed monthly or annually. All fees are non-refundable and must be paid in advance. There are no refunds or credits for partially used periods. By subscribing, you acknowledge and agree to these payment terms.

8. Free Tier Subscription

We offer a free tier subscription to GitAlert. However, we reserve the right to modify, cancel, or limit this free service without notice at any time. Users of the free tier will not be entitled to any compensation or damages upon the discontinuation or modification of the free service.

9. Personal Data and Privacy

We respect your privacy and commit to protecting your personal data. We only use your information for service provision and will not share it with third parties, except as required by law or as necessary to provide the Service. We implement robust data security measures. In the unlikely event of a data breach, we will make reasonable efforts to notify affected users promptly and take necessary steps to mitigate any harm, without assuming responsibility for such breaches.

10. Limitation of Liability

In no event shall Yevhen Salitrynskyi be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, any errors, loss of data, interruption, or unavailability of the Service.

11. Intellectual Property

All rights, title, and interest in and to the GitAlert Service and its components, including any intellectual property rights, will remain with and belong exclusively to Yevhen Salitrynskyi. Your use of the Service does not grant you any rights to use or control any intellectual property of GitAlert or its licensors.

12. Service Maintenance and Downtime

The Service may undergo maintenance, resulting in interruptions, delays, or errors. We do not guarantee continuous, uninterrupted, or error-free operation of the Service and will not be liable for any loss, damages, or expenses incurred due to maintenance or downtime, even after the beta period ends.

13. Termination of Service

GitAlert values its relationship with users and aims to avoid terminating services without cause. However, GitAlert reserves the right to terminate or suspend your access to the Service at any time, including, without limitation, for breach of these Terms or for no specific reason. If termination is due to your breach of these Terms, no refund will be provided. In the rare event that GitAlert needs to terminate your service without cause, we will issue a prorated refund. This refund will be calculated based on the unused portion of your service term, starting from the first minute of the day following termination. In both scenarios, upon termination, your right to use the Service will cease immediately.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Ontario.

15. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Any failure by GitAlert to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Feedback and Suggestions

Any feedback, comments, ideas, improvements, or suggestions (collectively, "Suggestions") provided by you to GitAlert regarding the Service will remain the sole and exclusive property of GitAlert. GitAlert shall be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or any compensation to you.
